Purpose of processing and applicable legal grounds

As Data Controller, Rega Energy processes personal data of Users of the website www.regaenergy.com (“Website“). This document contains information about the processing of personal data which is being carried out.

Personal data collected through the Website will be processed for the following purposes and on the following legal grounds:

  • Analysis of contacts made by potential REGA ENERGY Customers or Partners through the Website. In this case, we will process the personal data of the employees and/or legal representatives of potential Customers or Business Partners of REGA ENERGY (whenever they are legal persons), or the personal data of the potential Business Partners (whenever they are contractors working on their own), the applicable legal grounds being, respectively for each case, (i) our legitimate interest in answering the questions raised and, when applicable, taking the necessary steps to establish contractual relations or (ii) the performance of a contract to which the data subject is a party, or for pre-contractual steps at the request of the data subject.
  • Processing of cookies for the purpose of efficient delivery of fonts and to improve the performance of loading fonts on the Website, based on our legitimate interest in providing you with a pleasant and efficient experience while browsing the Website (for additional information on the cookies used please refer to our Cookie Policy).
  • Processing job applications at REGA ENERGY, either for open positions or spontaneous applications. In this case, the applicable legal ground will be REGA ENERGY’s legitimate interest in analyzing the applications submitted, as well as, in the case of candidates who are hired, taking pre-contractual or contractual steps at the request of the data subject.

If you are not admitted to the position you have applied to (in the case of an application for a specific position), we may retain your personal data in our database for a period of 2 (two) years to assess your profile for potential vacancies at REGA ENERGY. However, we note that we will only carry out this storage if you give us your consent to do soThe consent you provide is freely revocable at any time, without compromising the lawfulness of the processing that has been carried out up to that point and without any negative consequences for the data subject.

Regarding spontaneous applications, we will keep your data for a period of 2 (two) years from the time of application, to assess your profile for potential vacancies at REGA ENERGY. If you do not wish us to retain your data, you can object to the processing of your personal data by sending an email to the address indicated in “Rights of data subjects”.

Transfer of personal data

We may transfer the personal data being processed to any company of which REGA ENERGY holds (directly or indirectly) a stake in its share capital, to information technology service providers who provide us with website management and maintenance services, as well as to third parties for the purposes of complying with legal obligations applicable to each case.

 

Retention of personal data

Your personal data will be kept for the period strictly necessary to fulfill the purposes for which it was collected or for the period strictly necessary to comply with any legal obligation.

In the case of applications, your personal data will be kept for a period of 5 (five) years.  In this case, personal data will not be processed for any other purpose, unless one of the situations described in point iii. of the section “Purpose of processing and applicable legal grounds” occurs.

 

Data subjects’ rights

Data subjects may, as applicable, exercise the following rights in relation to the processing of their personal data:

  • Access: they can obtain information about whether we are processing their personal data, as well as consult their personal data;
  • Rectification: they can change personal data when it is incorrect, as well as complete incomplete data;
  • Erasure: they may request the erasure of personal data when, among other reasons, the personal data is no longer necessary for the purposes for which it was collected;
  • Opposition: in certain situations, they may request that personal data cease to be processed. In this case, we will cease processing the personal data, unless there are legitimate grounds for continuing the processing or if it is necessary for the establishment, enforcement or defense of rights in an administrative, judicial or extrajudicial proceeding;
  • Restriction of processing: the data subjects may request that we restrict the processing of their personal data in the following situations: (a) during the contestation of the accuracy of your personal data, (b) when the processing is lawful and they have objected to it and requested the limitation of the use of personal data, (c) when we no longer need to process personal data, but we need it for the enforcement or defense of rights in an administrative, judicial or extrajudicial proceeding; (d) when they have opposed to the processing of their personal data for the fulfillment of an obligation of public interest or for the satisfaction of a legitimate interest, as long as it is verified that these legitimate reasons for the processing prevail over the data subjects’ own reasons;
  • Portability: in certain situations, data subjects will have the right to receive, in a structured, commonly used and automatically readable format, the personal data they have made available to us and those obtained from their relationship with us, as well as to transfer them to another entity.

For any question or exercise of these rights, an email should be sent to rgpd@regaenergy.com for the exercise of rights, without prejudice to the fact that, if necessary, we may ask the data subjects to send a document proving their identity. The data subjects must also indicate the right they wish to exercise. The exercise of rights is free of charge, except in the case of a manifestly unfounded, excessive or repeated request.

Finally, we point out that data subjects can lodge a complaint with the National Data Protection Commission (www.cnpd.pt).

 

Changes to the Privacy Notice

REGA ENERGY may change the content of the Privacy Notice at any time.

Any changes to the Privacy Notice will be communicated by a pop-up or an e-mail to Users who have used the contact forms available on the Website.
